The Stellar Rise Foundation — Terms of Use

1. Acceptance of Terms
By accessing or using stellarrisefoundation.org (the "Site"), you agree to these Terms of Use and our Privacy Policy. If you do not agree, please do not use the Site.
2. Use of the Site
The Site and its content are provided for informational and nonprofit fundraising purposes. You agree to use the Site lawfully and not to: interfere with or disrupt the Site or its servers; attempt to gain unauthorized access to any part of the Site; scrape, harvest, or collect information about other users; or use the Site to transmit harmful code.
3. Intellectual Property
All content on the Site — text, images, logos, and design — is owned by The Stellar Rise Foundation or its licensors and is protected by copyright and trademark law. You may view and share Site content for personal, noncommercial purposes, but may not reproduce, distribute, or create derivative works from it without our written permission.
4. Donations and Payments
- Donations are processed securely through Givebutter and its payment-processing partners; Stellar Rise does not store your full card or bank details.
- All donations are final and non-refundable, except where required by law or at Stellar Rise's sole discretion in cases of clear error (e.g., duplicate or mistaken charges) — contact us within 30 days to request review of such an error.
- Recurring (weekly, monthly, quarterly, or annual) donations continue until you cancel; you may cancel at any time by contacting us or through your Givebutter donor account.
- Donors are responsible for providing accurate payment and contact information. We reserve the right to decline or return a donation at our discretion, including where we cannot verify the source of funds.
- Stellar Rise is a registered 501(c)(3) nonprofit organization (EIN 39-2601000). Donations are tax-deductible to the extent permitted by law; no goods or services are provided in exchange for a donation unless explicitly stated at the time of giving.
5. Third-Party Links and Services
The Site may link to third-party websites or services we do not control, including our donation platform (Givebutter) and social media pages. We are not responsible for the content, privacy practices, or terms of any third-party site, and linking to a site does not imply our endorsement of it. Review the applicable third party's own terms and privacy policy before providing information to them.
6. Disclaimer of Warranties
The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or completely secure.
7. Limitation of Liability
To the fullest extent permitted by law, The Stellar Rise Foundation, its officers, directors, employees, and volunteers will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site, even if advised of the possibility of such damages. Nothing in this section limits liability where such limitation is not permitted by applicable law.
8. Indemnification
You agree to indemnify and hold harmless The Stellar Rise Foundation from claims, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site.
9. Termination of Access
We may suspend or terminate your access to the Site, without notice, if we believe you have violated these Terms or applicable law.
10. Accessibility
We aim to make this Site usable for people of all abilities, consistent with our trauma-informed, dignity-first mission. If you experience difficulty accessing any part of the Site or need information in an alternative format, contact us using the information in Section 14 and we will do our best to accommodate you.
11. Governing Law
These Terms are governed by the laws of the State of Michigan, where The Stellar Rise Foundation is incorporated, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Michigan, except where applicable consumer-protection law provides otherwise.
12. Changes to These Terms
We may update these Terms from time to time. The "Effective Date" above reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
13. Severability; Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Stellar Rise Foundation regarding use of the Site.
